These Terms & Conditions govern the use of the GT Designs website and the purchase of products and services through our online store.

By accessing this website, creating an account, submitting an order, uploading artwork, requesting a design, making payment or otherwise using our services, you agree to be bound by these Terms & Conditions.

If you do not agree with these Terms & Conditions, please do not use the website or place an order.

GT Designs (Pty) Ltd is referred to in these Terms & Conditions as “GT Designs”, “we”, “us” or “our”.

The person purchasing products or services from GT Designs is referred to as “the customer”, “you” or “your”.


2. ACCEPTANCE OF THESE TERMS

By placing an order through our website, you confirm that:

  • You have read and understood these Terms & Conditions;
  • You agree to be bound by these Terms & Conditions;
  • The information you provide is accurate and complete;
  • You have authority to use the payment method provided;
  • You have the necessary rights or permissions to use any artwork, logos, photographs, trademarks or other material uploaded to our website; and
  • You agree to comply with all applicable laws when using our website and services.

These Terms & Conditions should be read together with our:

  • Refund, Returns & Cancellation Policy;
  • Privacy Policy;
  • Delivery & Collection information; and
  • Any quotation, order confirmation or other written agreement applicable to your order.

3. ABOUT OUR PRODUCTS AND SERVICES

GT Designs provides customised design, printing, branding and related services.

Our services may include, but are not limited to:

  • UV Printing;
  • DTF Printing;
  • Sublimation;
  • Embroidery;
  • Corporate Clothing;
  • Corporate Gifts;
  • Branding;
  • Signage;
  • Graphic Design;
  • Promotional Products;
  • Custom Printed Products; and
  • Other customised products and services offered through the website.

Because many of our products are manufactured or customised according to individual customer requirements, the final product may differ slightly from digital representations shown on the website.


4. WEBSITE INFORMATION

We make reasonable efforts to ensure that information displayed on the website is accurate and up to date.

However, we do not guarantee that:

  • Product images will exactly represent the physical product;
  • Colours displayed on your screen will exactly match the printed product;
  • Product dimensions displayed online will be exact where manufacturing tolerances apply;
  • All products will always be available;
  • All website information will always be error-free; or
  • The website will always be available without interruption.

We reserve the right to correct errors, update information and change product specifications where reasonably necessary.

Where an error materially affects an order, we will communicate with the customer where appropriate.


5. PRODUCT PRICES

All prices displayed on the website are subject to change without prior notice.

The price applicable to an order is the price displayed at the time the customer places the order, subject to any obvious pricing error.

Where applicable, product prices may exclude:

  • Delivery fees;
  • Artwork or design charges;
  • Additional customisation;
  • Rush production charges;
  • Installation;
  • Additional materials; or
  • Other charges specifically identified during checkout or quotation.

Where a quotation is provided, the quotation will specify the applicable pricing and validity period.


6. PRICING ERRORS

We make reasonable efforts to ensure that product prices are displayed correctly.

If a product has been listed at an obviously incorrect price due to a technical, typographical or system error, GT Designs reserves the right to contact the customer before fulfilling the order.

Where the incorrect price is materially different from the intended price, GT Designs may offer the customer the option to proceed at the correct price or cancel the affected order.

Any refund due following cancellation will be handled in accordance with applicable law.


7. PLACING AN ORDER

Customers may place orders through the online store by selecting the desired products, quantities, specifications and available customisation options.

Depending on the product, customers may also be required to:

  • Upload artwork;
  • Enter personalised information;
  • Select colours;
  • Select sizes;
  • Select printing or branding options;
  • Provide delivery information;
  • Request design services; or
  • Provide additional production instructions.

The customer is responsible for ensuring that all information submitted with an order is correct.


8. ORDER ACCEPTANCE

Submitting an order through the website does not necessarily mean that GT Designs has accepted the order for production.

An order may be subject to:

  • Payment confirmation;
  • Artwork verification;
  • Stock availability;
  • Production capacity;
  • Technical feasibility;
  • Confirmation of specifications; or
  • Other reasonable checks.

GT Designs may contact the customer if additional information or clarification is required.

An order will be considered accepted for processing once GT Designs has confirmed the order and the applicable requirements have been satisfied.


9. PAYMENT

Payment must be made using the payment methods made available through the website or otherwise agreed with GT Designs.

Orders requiring payment in advance will only proceed once payment has been successfully received or confirmed.

GT Designs is not responsible for delays caused by:

  • Failed payments;
  • Incorrect payment information;
  • Bank processing delays;
  • Payment-provider outages;
  • Fraud-prevention checks; or
  • Other circumstances outside our reasonable control.

For large, corporate or customised orders, GT Designs may require a deposit or full payment before production begins.


10. PAYMENT SECURITY

Online payments may be processed through third-party payment service providers.

GT Designs does not ordinarily have access to customers’ full card details where payment is processed through a secure third-party payment gateway.

Customers are responsible for ensuring that their payment information and account credentials are kept secure.


11. CUSTOMER ACCOUNTS

Certain website functions may require customers to create an account.

Customers are responsible for:

  • Providing accurate information;
  • Maintaining the confidentiality of their login credentials;
  • Keeping account information up to date; and
  • All activity conducted through their account, subject to applicable law.

Customers should immediately notify GT Designs if they believe their account has been accessed without authorisation.

GT Designs may suspend or terminate an account where there is reasonable evidence of misuse, fraud, abuse or violation of these Terms & Conditions.


12. CUSTOMER ARTWORK

Customers may upload artwork for GT Designs to print, embroider, engrave, reproduce or otherwise apply to products.

By uploading artwork, the customer confirms that they have the necessary rights, licences or permissions to use the artwork.

The customer remains responsible for the legality of all material supplied to GT Designs.

This includes:

  • Logos;
  • Company trademarks;
  • Photographs;
  • Illustrations;
  • Artwork;
  • Fonts;
  • Text;
  • Designs;
  • Copyrighted material; and
  • Other intellectual property.

GT Designs does not assume responsibility for determining whether customer-supplied artwork infringes the rights of another person or organisation.


13. PROHIBITED CONTENT

GT Designs reserves the right to refuse to reproduce, print, embroider or otherwise process content that we reasonably believe:

  • Is unlawful;
  • Infringes copyright, trademark or other intellectual property rights;
  • Promotes violence or criminal activity;
  • Contains unlawful hate speech;
  • Contains defamatory material;
  • Contains fraudulent or misleading material;
  • Is sexually explicit or otherwise inappropriate;
  • Violates the rights of another person; or
  • May expose GT Designs to legal liability.

Where an order is refused for this reason, GT Designs will assess any refund or cancellation in accordance with the circumstances and applicable law.


14. COPYRIGHT AND INTELLECTUAL PROPERTY

All website content belonging to GT Designs, including where applicable:

  • Logos;
  • Branding;
  • Text;
  • Graphics;
  • Photographs;
  • Product images;
  • Website design;
  • Original artwork;
  • Marketing material; and
  • Other original content

remains the property of GT Designs or its respective licensors unless otherwise stated.

Such material may not be copied, reproduced, modified, distributed or commercially exploited without appropriate permission.


15. CUSTOMER-SUPPLIED INTELLECTUAL PROPERTY

Customers retain ownership of artwork and intellectual property that they own and supply to GT Designs.

By submitting such material, the customer grants GT Designs permission to use, reproduce, modify where necessary, store and process the material solely for the purpose of providing the ordered products or services.

This permission may include preparing artwork for production, creating print files, adjusting sizing or positioning and making technical changes necessary to fulfil the order.


16. DESIGN SERVICES

Customers may request GT Designs to create artwork or designs for their products.

Where a design service is purchased:

  • The customer must provide accurate instructions;
  • The customer should provide all required logos, images, wording and specifications;
  • Design work may be subject to a separate design fee;
  • The number of revisions may be limited where specified in the quotation;
  • Additional revisions may attract additional charges; and
  • Production will only proceed once the applicable design approval has been received.

Unless otherwise agreed in writing, payment for a design service does not automatically transfer ownership of GT Designs’ underlying design concepts, working files or source files to the customer.


17. ARTWORK APPROVAL

Where GT Designs provides an artwork proof, the customer is responsible for carefully reviewing it before approval.

The customer should verify:

  • Spelling;
  • Names;
  • Numbers;
  • Dates;
  • Colours;
  • Logos;
  • Images;
  • Positioning;
  • Product sizes;
  • Quantities; and
  • Other specifications.

Once artwork has been approved, GT Designs may proceed with production.

The consequences of approving incorrect customer-supplied information are addressed further in our Refund, Returns & Cancellation Policy.


18. COLOUR VARIATIONS

Customers acknowledge that colour displayed on a computer, tablet or mobile device may differ from the final physical product.

Differences may occur due to:

  • Screen settings;
  • Different display technologies;
  • Printing processes;
  • Material characteristics;
  • Ink or toner;
  • Fabric;
  • Lighting;
  • Printing profiles; and
  • Manufacturing processes.

Minor colour variations that fall within reasonable production tolerances will not necessarily constitute a defect.

Where an exact colour specification is commercially important, customers should discuss the requirement with GT Designs before placing the order.


19. CUSTOM PRODUCTS

Custom products are produced according to the specifications selected or supplied by the customer.

The customer accepts responsibility for ensuring that the following are correct before production:

  • Product;
  • Size;
  • Quantity;
  • Colour;
  • Design;
  • Artwork;
  • Text;
  • Personalisation;
  • Logo;
  • Delivery details; and
  • Other specifications.

Because custom products are made specifically for the customer, cancellation and return rights may differ from those applicable to standard products.

The applicable rules are set out in our Refund, Returns & Cancellation Policy and remain subject to applicable consumer legislation.


20. PRODUCTION TIMES

Production times may vary depending on:

  • Product type;
  • Order quantity;
  • Artwork requirements;
  • Material availability;
  • Production workload;
  • Customisation requirements;
  • Supplier availability;
  • Public holidays;
  • Delivery method; and
  • Other factors affecting production.

Any production timeframe displayed on the website is an estimate unless a specific completion date has been expressly agreed in writing.

Customers should contact GT Designs before ordering if an order is required for a specific event or deadline.


21. URGENT OR RUSH ORDERS

Customers may request urgent production where available.

Rush orders are subject to:

  • Production capacity;
  • Material availability;
  • Artwork readiness;
  • Additional fees where applicable; and
  • Confirmation by GT Designs.

A rush order is not considered accepted until GT Designs confirms the required production timeframe.


22. DELIVERY

Where delivery is selected, the customer must provide accurate delivery information.

GT Designs is not responsible for delays resulting from incorrect or incomplete information supplied by the customer.

Delivery times may be affected by:

  • Courier delays;
  • Weather;
  • Traffic;
  • Public holidays;
  • Incorrect addresses;
  • Recipient unavailability;
  • Operational disruptions; or
  • Other circumstances outside GT Designs’ reasonable control.

Delivery timeframes are estimates unless a specific delivery date has been expressly agreed.


23. DELIVERY ADDRESS

Customers must ensure that the delivery address is complete and accurate.

Additional delivery charges may apply where:

  • The address is incorrect;
  • The customer requests a change after dispatch;
  • A second delivery attempt is required due to customer unavailability;
  • The delivery area attracts an additional courier charge; or
  • The courier incurs additional charges due to circumstances attributable to the customer.

24. STORE COLLECTION

Customers may select store collection where this option is available.

Customers will be notified when an order is ready for collection.

Customers collecting orders may be required to provide:

  • Order number;
  • Proof of purchase;
  • Identification; or
  • Other reasonable verification.

A customer may authorise another person to collect an order, provided the required collection information is supplied.


25. INSPECTION OF ORDERS

Customers should inspect their order when receiving or collecting it where reasonably possible.

If an order appears damaged, incorrect or incomplete, the customer should notify GT Designs as soon as reasonably possible.

Nothing in this section limits any statutory rights available to the customer.


26. REFUNDS, RETURNS AND CANCELLATIONS

Refunds, returns and cancellations are governed by our separate Refund, Returns & Cancellation Policy.

That policy forms part of these Terms & Conditions.

Nothing in these Terms & Conditions excludes or limits consumer rights that cannot lawfully be excluded or limited.

The CPA contains protections concerning fair contract terms and consumer rights, including protections against unfair, unreasonable or unjust terms.


27. STATUTORY CONSUMER RIGHTS

GT Designs respects all applicable consumer rights under South African law.

Where applicable, transactions may be governed by legislation including:

  • Consumer Protection Act 68 of 2008;
  • Electronic Communications and Transactions Act 25 of 2002; and
  • Other applicable South African legislation.

The ECTA regulates electronic transactions and provides a legal framework for electronic communications and online transactions.

Nothing in these Terms & Conditions is intended to deprive a consumer of a right or remedy that cannot lawfully be excluded.


28. PRODUCT QUALITY

GT Designs aims to provide products that meet the agreed specifications and applicable quality requirements.

Where a product is defective, unsafe, incorrectly supplied or otherwise subject to a statutory remedy, the matter will be handled in accordance with applicable law and our Refund, Returns & Cancellation Policy.


29. THIRD-PARTY SERVICES

GT Designs may use third-party service providers for services such as:

  • Payment processing;
  • Courier and delivery services;
  • Website hosting;
  • Email delivery;
  • Online security;
  • Cloud storage; and
  • Other operational services.

Where third-party services are used, their own terms and conditions may also apply.

GT Designs will remain responsible for its obligations under the applicable customer transaction to the extent required by law.


30. WEBSITE AVAILABILITY

We aim to keep the website available and functioning correctly.

However, we do not guarantee uninterrupted access.

The website may occasionally be unavailable due to:

  • Maintenance;
  • Software updates;
  • Hosting problems;
  • Security incidents;
  • Technical faults;
  • Internet connectivity issues;
  • Third-party service interruptions; or
  • Other circumstances beyond our reasonable control.

31. WEBSITE SECURITY

Customers must not:

  • Attempt to gain unauthorised access to the website;
  • Introduce malicious software;
  • Interfere with website functionality;

  • Use automated systems to abuse the website;
  • Conduct fraudulent transactions; or

33. PRIVACY AND PERSONAL INFORMATION

GT Designs may collect and process personal information required to:

  • Process orders;
  • Process payments;
  • Provide design services;
  • Deliver products;
  • Communicate with customers;
  • Provide customer support;
  • Manage customer accounts;
  • Prevent fraud; and
  • Comply with legal obligations.

Personal information will be handled in accordance with our Privacy Policy and applicable South African data-protection laws.

Customers should review our Privacy Policy before using the website.


34. CUSTOMER COMMUNICATIONS

By placing an order, customers agree that GT Designs may contact them regarding their transaction.

35. REVIEWS AND CUSTOMER CONTENT

Where the website permits customers to submit reviews, comments, photographs or other content, customers must ensure that such content is accurate and lawful.

Customers must not submit content that:

  • Is fraudulent;
  • Is defamatory;
  • Infringes another person’s rights;
  • Contains unlawful material;
  • Contains malicious software; or
  • Is intended to mislead other customers.

GT Designs may remove content that violates these requirements or applicable law.


36. PROMOTIONS AND DISCOUNTS

Promotions, discounts and special offers may be subject to additional terms.

Unless otherwise stated:

  • Promotions cannot be exchanged for cash;
  • Promotions may have expiry dates;
  • Promotional products remain subject to these Terms & Conditions; and
  • GT Designs may correct obvious promotional or pricing errors.

Any promotion-specific terms displayed at the time of the promotion will apply.


37. AVAILABILITY OF PRODUCTS

Products displayed on the website are subject to availability.

If a product becomes unavailable after an order has been placed, GT Designs will contact the customer where appropriate and may offer:

  • An alternative product;
  • A revised production timeframe; or
  • Cancellation and refund where applicable.

38. EVENTS BEYOND OUR CONTROL

GT Designs will not be responsible for delays or failure to perform an obligation where the cause is beyond our reasonable control.

Such circumstances may include:

  • Natural disasters;
  • Fire;
  • Flood;
  • Severe weather;
  • Power outages;
  • Internet outages;
  • Equipment failure;
  • Supplier failure;
  • Courier disruptions;
  • Strikes;
  • Civil unrest;
  • Government restrictions;
  • Epidemics or pandemics;
  • War; or
  • Other circumstances beyond our reasonable control.

Where such an event materially affects an order, GT Designs will communicate with the customer where reasonably possible.


39. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, GT Designs will not be responsible for losses that are:

  • Not reasonably foreseeable;
  • Indirect or consequential; or
  • Caused by information, artwork or instructions incorrectly supplied by the customer.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms & Conditions is intended to exclude or limit statutory consumer rights, liability for fraud, or any other liability that cannot lawfully be excluded or limited.


40. CUSTOMER RESPONSIBILITY FOR ARTWORK

Where the customer supplies artwork, the customer is responsible for ensuring that they have permission to reproduce the material.

The customer agrees to indemnify GT Designs, to the extent permitted by law, against third-party claims arising directly from the customer’s unlawful use or submission of material that infringes another person’s rights.

This provision does not apply to the extent that the claim results from GT Designs’ own unlawful conduct, negligence or breach of applicable law.


41. ORDER RECORDS

GT Designs may retain records relating to customer orders, including:

  • Order details;
  • Customer information;
  • Payment information or payment references;
  • Artwork;
  • Proof approvals;
  • Communications;
  • Delivery information; and
  • Transaction records.

Records will be handled in accordance with applicable legal requirements and our Privacy Policy.


42. ELECTRONIC COMMUNICATIONS

When you use the website, send us an email, submit an online order or communicate with us electronically, you consent to receiving electronic communications relating to your transaction.

Electronic records and communications may be retained as evidence of transactions and approvals, subject to applicable law.


43. NOTICES AND APPROVALS

Where GT Designs requests confirmation or approval from a customer, the customer may provide approval electronically unless another method is specified.

Examples include:

  • Email approval;
  • Website confirmation;
  • WhatsApp confirmation;
  • Online approval; or
  • Other written electronic confirmation.

Customers should retain copies of important approvals and communications relating to their orders.


44. DISPUTE RESOLUTION

If you have a complaint or dispute concerning an order, please contact GT Designs first so that we can attempt to resolve the matter directly.

Complaints should be submitted with sufficient information to allow us to investigate the matter.

Where a dispute cannot be resolved directly, either party may exercise any rights or remedies available under applicable South African law.

Nothing in this section prevents a consumer from approaching a competent regulatory authority, consumer body, ombud or court where the law permits them to do so.


45. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute concerning these Terms & Conditions or a transaction with GT Designs will be dealt with in accordance with applicable South African law.

Nothing in this clause prevents a consumer from exercising any statutory right to approach a competent court, regulator, ombud or other dispute-resolution body.


46. CHANGES TO THESE TERMS & CONDITIONS

GT Designs may update these Terms & Conditions from time to time.

The updated version will be published on the website with a revised “Last Updated” date.

Changes will generally apply to transactions placed after the updated Terms & Conditions have been published, unless otherwise required by law.

The Terms & Conditions applicable to an existing order will not be changed retrospectively in a manner that unlawfully affects the customer’s rights.


47. SEVERABILITY

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be interpreted or amended to the extent necessary to make it lawful where legally possible.

The remaining provisions will continue to apply to the extent permitted by law.


48. NO WAIVER

If GT Designs does not immediately enforce a provision of these Terms & Conditions, this does not mean that GT Designs has permanently waived its right to enforce that provision.

Any waiver must be considered in the context of the specific circumstances and applicable law.


49. ENTIRE AGREEMENT

These Terms & Conditions, together with the applicable:

  • Product information;
  • Order confirmation;
  • Quotation;
  • Refund, Returns & Cancellation Policy;
  • Privacy Policy; and
  • Any additional written agreement between GT Designs and the customer,

form the applicable agreement concerning the relevant transaction, subject to applicable law.

Where a specific written quotation or agreement contains terms that expressly apply to a particular order, those terms will apply to that order to the extent they are lawful and consistent with applicable consumer legislation.
